Navi Technologies, Inc. and its affiliates ("Navi") offers mapping, GPS navigation, and community-based services to users of our website, www.Navi.app (the Website”), and our mobile and web application (the “App”, and collectively with the Website referred to as the "Services"). When you use our Services, you entrust us with your information. 

This Privacy Notice explains the information we collect from and about you, and how we use that information. It also details how you can update, manage, and delete your information. Specifically, it covers:

To use our Services you must be 18 years of age or older. If you are under 18, you may not download or use the Services.

In this Privacy Notice, the term “personal information” means information  that personally identifies you, such as your name, email address or billing information, and, in certain circumstances, your location and route information or other data which can be reasonably linked to such information.

You can adjust your privacy settings in the Navi App and choose which personal information we may collect about you and how your information is used.

1. Services and User Accounts

When you use our Services, Navi will create an account for you and collect and use your information and metadata, as outlined in this Privacy Notice. This applies whether or not you actively register your account, for example by adding your phone number. You may use the Navi Services without registering your account by skipping the registration process. 

If you do not register your account:

  • Navi assigns a unique identifier to every non-registered account and links all your information to it, even if you haven't registered. This identifier and the linked information are only visible to Navi, and help Navi retrieve relevant information, like location-based search results.
  • You can link your non-registered account across multiple devices and browsers using tools like QR codes. Once linked, information from all these devices will be associated with your non-registered account.
  • Some features, like hazard reporting, routing, and sharing, are only available if you register your account through the App.

If you do register your Account:

  • Navi will link all of your information with your registered account. This includes information received from all devices and browsers which you have chosen to sign in;
  • With the exception described in the bullet below and as explained in the section “Visibility” below, your account and information associated with your account (including your internal unique identifier) will be visible only to Navi; and
  • When using the Services, your approximate location and other information you may choose to contribute will be visible to other Navi contacts associated with this account.
  • Navi may also establish and require from time to time additional or different means of identification and authentication for logging in and accessing the Services or for accessing certain features or designated sections of the Services.
  • Your login details are your responsibility. You are fully accountable for any use or misuse of your account and personal details as a result of conveying your login details to someone else. You must maintain your login details in absolute confidentiality and avoid disclosing them to others. 

2. Data Collection

Navi gathers information to enhance its services for all users. This includes determining the optimal route and monitoring traffic to suggest departure times. The data collected and its usage depend on how you utilize our Services and manage your privacy settings.

Information you create or provide to us:

  • Account Information: information required when setting up an Account, such as your name or email address. Bear in mind that false, incorrect, or out-dated information may impair Navi’s ability to provide you with the Services and to contact you when necessary. Navi will explicitly indicate which  fields are mandatory. If you do not enter the requisite data in these fields, you may not be able to register your account or to be provided with certain features (but you may still use our Services as explained in the above section “User Accounts & Accessing the Services”); and/or
  • Information that you choose to share with Navi: information that you choose to share with Navi, including a username you have chosen, reports associated with your username, phone number, “home” or “work” addresses, other locations you designate as “favorites”, destinations you may travel to, search queries, calendar information (if you choose to activate and use certain Service features like time to leave reminders) and files you have uploaded to the Services, if applicable. Even if you aren’t registered to a Navi account, you might choose to provide us with information.
  • Communication which you choose to conduct through the Navi Services:  information collected if you choose to use Navi to communicate with other Navi users or third parties through the Navi Services, such as chat messages or pinned locations sent to others via the Navi platform. We may also collect information when you exchange communication with Navi, for example, if you submit a request, contact Navi’s support team, or report a violation to the abuse team.

We may use any additional information you provide to personalize and enhance your experience with the Services. For example, if you give us your home and work addresses, we may determine and provide you with the optimal route between those locations.

3. Data Navi Collects

Navi collects information about your activity within the App to personalize your experience and enhance the Services we provide. This includes optimizing your search and travel by finding preferred routes and providing crowd-sourced or public safety data. The activity information we collect may include:

  • detailed location, travel, and route information, including GPS signals (with timestamps), 
  • IP addresses, and 
  • data from device sensors.

This creates a route history of all trips taken while using the app.The types of location data collected depend on your device and account settings.Depending on your settings, we may collect location and travel data even when you're not using the app to provide features like departure times, traffic alerts, parking assistance, ad analysis and more.

Navi collects information about the use of the Services and information from the device you have Navi installed on or the browser from which you use our Services. Navi may collect and record:

  • Frequency and duration of Service use.
  • Device type, unique identifiers, operating system type & version, battery usage
  • Third-party web pages or applications visited or used or interacted with via the App
  • Information viewed on our Services
  • Advertisements shown, viewed, or clicked on
  • Use of Services to communicate with other users and third parties via third-party application/services
  • Duration of communications
  • Internet Protocol (IP) address and domain name
  • Geographic location of the device used to log in and use Navi
  • Information about the interaction of your devices with our Services, including crash reports, system activity, and the date, time, and referrer URL of your request

4. Third Party Data

We collaborate with data partners, including advertisers on our platform, to deliver more relevant and useful experience based on your Navi activity and device identifier information. This information is shared with us by our partners.

Information about how users interact with our products may be collected by third-party measurement services and shared with us in an aggregated, non-personally identifiable format. Additionally, we may receive information from third-party services regarding the effectiveness of Navi's marketing efforts on external sites or platforms.

A variety of technologies may be utilized to collect and store information, including cookies, Advertising ID (available on Android mobile devices), local storage, browser web storage, application data caches, databases, and server logs.

5. Why Navi Requires Data

The information Navi collects or receives from you may be used for the following purposes:

A. Providing the Navi Service

We use your information to deliver our Services. For example:

  • We use your location, route information, and/or search query history to provide you with navigation services, safety scores, public safety information, and emergency alerts. We also use this information to share details about nearby sites, shops, and other places of interest.
  • We may share your submissions with other users of our Services to enable and facilitate communication between you, Navi, and other users.
  • In accordance with the "Advertising" section of this Privacy Notice, we may use your information to provide you with advertising services, including personalized ads.
B. Maintain & Improve Navi 

We track outages and troubleshoot reported issues to ensure our services are working as intended. Additionally, we use your information to enhance our Services and develop new features and services. For instance, your route information can help Navi improve the accuracy of its mapping, scoring, and navigation data.

C. Personalized Services

The information we collect is used to operate and personalize your experience with the Services. For example, if you choose to provide your “home”, “work”, and other “favorites” information, or your route history, Navi may use it to offer routes based on your past travel between favorite destinations. Additionally, based on your activity and settings, we may suggest drive predictions, common destinations, and personalize your ETA. We may also use the information to provide support and handle requests and complaints.

Depending on your settings, we may also show you personalized ads based on your interests and activity. For more information, see the "Advertising" section under this Privacy Notice.

D. Communication

We will also use your information to:

  • Send you updates, notices, announcements, user requests, and other information related to the Services (including through push notifications, email, and SMS).
  • Conduct surveys and questionnaires.
  • Keep a record of your requests (if you contact Navi) to help solve any issues you might be having.
  • Send you promotional and/or marketing materials, subject to your prior express consent (to the extent required by applicable law) and only to the email address you provided. You can unsubscribe from these emails or texts at any time by clicking the “Unsubscribe” link or responding with “STOP”.

You should note that in using the Service, your information will travel through third party infrastructures which are not under our control (such as a third party SMS delivery platform or your carrier network). We cannot protect, nor does this Policy apply to, any information that you transmit to other users. A mobile user might opt-in by entering a phone number in the app.

Navi’s third-party service provider gives you the ability to opt out of the Service for any reason. You can opt out by texting “STOP” or “QUIT” to any communication from Navi.

We reserve the right to send you certain communications relating to the Service, such as announcements and administrative messages, without offering you the opportunity to opt-out of receiving them.

E. For Navi User Protection

We may also use and process your information and content, using different technologies for the following purposes:

Navi may use your information for the following reasons:

  • To comply with applicable laws and assist law enforcement agencies when legally required or when Navi believes it meets legal standards and procedures
  • To enforce our Terms of Use or other agreements
  • To contact you when necessary
  • To detect, prevent, and respond to fraud, abuse, illegal activity, identity theft, and other misuse of our Services
  • To address breakdowns and malfunctions
  • To take action in disputes or legal proceedings between you and Navi, other users, or third parties regarding the Services
  • To improve the safety and reliability of our Services, including detecting, preventing, and responding to security risks and technical issues
  • To create aggregated and/or anonymous data that does not identify specific users
  • For other purposes stated in our Privacy Notice and Terms of Use

We will obtain your consent before using your information for any purpose not stated within this Privacy Notice.

6. Information Sharing

The Services are built on a community of users who publicly share information with Navi and other community members. Users may choose to share personal information, including name, age, gender, picture, location, reports, and other files. This information may be shared with all users (e.g., traffic reports) or only with your Navi contacts. It may also be shared via third-party services (e.g., social networks) that interact with the Services.

You can choose whether to upload content to the Services. Any content you share and submit for posting is not private or confidential and may be made public. Uploaded information will be posted with your username and other information, including personal information attached to your public profile. For example, your reports (map and road updates, traffic congestion updates, road accidents, etc.) will be posted on the Navi map with your username. Some road incident reports may include your driving path near those incidents.

You should use caution and common sense when submitting information. Use at least the same degree of caution as when publishing personal information by other means.

Your email address will not be displayed to others in any reports or user posts that you share or upload. However, this does not apply to information shared from your social network accounts, which is governed by your privacy settings for those accounts.

If you decide to record your voice onto the Service or use voice command features, Navi will collect your voice information, including voice files. If you share your voice recordings, they will be available for download and use by other Navi users and other people. Once downloaded, Navi has no control over the voice files. Therefore, you should only share content that you are comfortable being made public.

Navi strives to deliver the best possible user experience, but we have no control over, and disclaim all liability for, the conduct of any user. We advise users to exercise caution and discretion when disclosing information and to carefully vet other users before engaging or communicating with them.

Users assume all risks associated with participating in any activities with other users as a result of using Navi. Navi is not a party to any user agreements and assumes no responsibility for users' compliance with laws, regulations, or other obligations. We are not liable for any loss, damage, cost, or expense incurred by users as a result of their participation in any activity or event initiated, held, or conducted by another user or third party, or as a result of any agreements between users or third parties, including any activity or event related in any way to the Services or their use.

7.  Social Networks and Data

If you choose to connect your Navi Account to your social network account, you can share information between the two services. This means that personal information and other content about you may be available from, transmitted to, and shared through social networks and the Services.

By connecting your Navi Account to social networks, you agree to share information (including personal information) between Navi and those social networks for the purposes outlined in this Privacy Notice.  How the social network uses the information Navi provides is governed by the social network’s privacy notices and is controlled by them, not by Navi or this Privacy Notice.

The first time you connect the Services to your social network account, the social network will ask you to permit it to share your personal information (such as your name, email address, profile picture, and other available information) with Navi. We collect this information in accordance with your granted permissions.

The Services may access, make available, and store information from your social network so that it is available on and through your Navi account until your Navi account is deleted.

8. Personal Information

You have the ability to review and update some of your information at any time by visiting your “Account & Login” settings (for example, your phone number, name, and profile picture) or the Navi destination list (for your home, work, and favorite locations).

It is important to make all necessary changes to correct any information associated with your Account that is not accurate, complete, or up-to-date. Please note that false, incorrect, or outdated information could prevent you from setting up an Account or hinder our ability to provide you with Services.

9.Controls

Your in-app “Privacy Settings” allow you to quickly access tools for safeguarding your data and managing how your information is used to improve your Navi experience.  For example, you can manage your map visibility and ad preferences.  You can also control the information Navi collects through device-level settings, such as location settings, regardless of whether you're signed in to a Navi account.

10. Removing Your Data

To delete your account, use the “Delete Account” function found in the in-app “Privacy Settings”. Upon receiving your request, Navi will make reasonable efforts to delete your information, although it may not be deleted immediately from our backup systems. The deletion process will begin immediately, and your data will no longer be used to personalize your Navi experience. Generally, it takes about 2 months from the time of the request to safely and completely delete your data from our storage systems. This timeframe may be affected by routine maintenance, unexpected outages, bugs, or protocol failures, although we have systems in place to identify and address such issues.

11. Data Retention

Data retention periods vary. You can delete some data at any time; other data is automatically deleted. In some cases, we retain data for longer when necessary. This section explains our data retention practices.

The following outlines how long we keep your data:

  • Information retained until you remove it: This includes your "home," "work," favorites, phone number, address and other account details, which we keep until you choose to remove or update it.
  • Data that expires after a specific period: We automatically delete some data after a set time. For example, calendar events are deleted after they occur. We may also anonymize some data within specific timeframes.
  • Information retained until your Navi account is deleted: Some data, such as the number of incident reports you've submitted, is kept for the life of your account to help us understand user interactions and improve our Services. This data is  deleted when you delete your account.
  • Information retained for extended time periods for limited purposes: For business and legal reasons, we keep some data for longer periods. This includes data for security, fraud prevention, financial record-keeping, legal compliance, service continuity, and direct communications with Navi.

12. Aggregated Information

Navi may use anonymous, statistical, or aggregated information, including anonymous location information, for various purposes. This data is used in a way that doesn't identify specific users. These purposes include operating and improving the Services, enhancing user experience, creating new services and features, including customized services, modifying or canceling existing content or service, and for other internal, commercial, and statistical purposes, including advertising.

Additionally, Navi may share this anonymous, statistical, or aggregated data collected on the Services with users of the Services, service providers, partners, and other third parties. This data is shared in a way that doesn't identify specific users. For example, GPS data from mobile devices may be provided to map editors in an aggregated and/or anonymous form to improve maps and solve map problems, and traffic data may be shared with cities.

13.Cookies

The Services may use cookies and similar technologies. Cookies are packets of information sent from the Website’s servers to your web browser, which are then sent back by the browser each time it accesses the Website’s servers.

Cookies may be used for a variety of purposes, including saving your username and password so you don't have to re-enter them each time you log in, facilitating use of the Website, collecting statistical information, verifying information, customizing the Website to your personal preferences, and for information security purposes.

Some of the cookies may expire when the session ends and you exit your browser; others are saved on your computer’s hard drive. If you want to block the Website’s cookies, please use the help button in your browser and follow the provided instructions. However, please note that disabling cookies may complicate or even prevent your use of the Website, or certain features thereof.

14. Advertising

Navi displays ads based on your current activity, location, destination, and search history. You can turn off ad personalization in your privacy settings. Navi doesn't show personalized ads based on sensitive categories Navi's internal messaging system allows you to send and receive messages from other users and marketing messages from Navi. Other users are not allowed to use your contact details for commercial advertising purposes.

15. Data Security

We have implemented systems, applications, and procedures designed to help secure your personal information and minimize the risk of theft, damage, loss, unauthorized access, or misuse. For example, we restrict access to personal information to Navi employees, contractors, and agents who need that information in order to process it. Anyone with this access is subject to contractual confidentiality obligations and may be disciplined or terminated if they fail to meet these obligations. The insights we gain from maintaining our Services help us detect and automatically block security threats before they  reach you.

However, these measures do not provide absolute assurance. We cannot guarantee, and you cannot reasonably expect, that our Services will be immune from any wrongdoings, malfunctions, unlawful interceptions or access, or other kinds of abuse and misuse.

16. Data Transfers

We maintain servers globally, so your data may be processed in a country other than your residence. Data protection laws differ by country, and some offer greater protection than others. We apply the protections outlined in this notice regardless of where your data is processed.

We respond to formal written complaints by contacting the complainant. We collaborate with relevant regulatory authorities, including local data protection authorities, to resolve any data transfer complaints that we cannot resolve directly with you.

17. U.S. State Law Requirements

The Privacy Notice explains how Navi handles user information, including what information is collected and why, when it may be shared, and how it is retained and aggregated. It also details how anonymized data is protected.

Navi provides users with tools to manage their privacy and data, including accessing, reviewing, updating, deleting, and exporting their information. Users can also turn off personalized ads in their in-app ad settings. To access and download their data archive, users can log in to the Navi website dashboard using their Navi account and valid email address.

For questions or requests related to their rights under U.S. state privacy laws, users or their authorized agents can contact Navi at [email protected]. If a user disagrees with a decision regarding their request, they can ask Navi to reconsider it by responding to the support team's email.

18. Privacy Notice Changes

Navi may occasionally update this Privacy Notice. Changes that are not material will take effect 7 days after they are posted on the Website. Substantial changes will take effect 30 days after Navi has posted a system message to users and a notification on the Website’s homepage or other relevant web pages, explaining the changes However, changes made to comply with legal requirements will become effective immediately upon posting, or as required.

Your continued use of the Services after any changes to this Privacy Notice indicates that you have read and understood those changes. If you do not agree with any of the changes, you should stop using the Services.
